1. Acceptance of Terms

By accessing or using Yealo ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all users, including event hosts, guests, and visitors.

2. Description of Service

Yealo is an event media platform that allows hosts to create events, collect photos and media from guests via shareable links and QR codes, manage galleries, and share event memories. The Service includes web and mobile applications, AI-powered features, and related tools.

3. Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 13 years old to create an account.
  • You are responsible for all activity that occurs under your account.
  • Notify us immediately if you suspect unauthorized access to your account.

4. User-Generated Content

4.1 Your Content

You retain ownership of all photos, videos, audio, and other content you upload to the Service. By uploading content, you grant Yealo a non-exclusive, worldwide license to host, store, display, and distribute your content solely for the purpose of operating the Service (e.g., displaying in galleries, generating thumbnails, delivering via CDN).

4.2 Guest-Uploaded Content

As an event host, you are responsible for the event link you share. Guests who upload content to your event grant the same license described above. You, as the host, are responsible for managing and moderating guest-uploaded content within your event.

4.3 Prohibited Content

You may not upload content that:

  • Violates any law or regulation.
  • Infringes on intellectual property rights of others.
  • Contains explicit, abusive, or harmful material.
  • Contains malware, viruses, or malicious code.
  • Impersonates another person or entity.

We reserve the right to remove any content that violates these terms without notice.

5. Pricing and Payments

  • Free-tier events are available at no cost with certain limitations (storage cap, active window, advertisements).
  • Paid tiers and add-ons are billed as one-time purchases per event through Stripe.
  • All prices are displayed in USD and are subject to change with notice.
  • Payments are non-refundable unless required by applicable law or at our sole discretion.
  • You are responsible for any applicable taxes.

6. Free Tier and Advertisements

Free-tier events may display advertisements from third-party ad networks. By using the free tier, you acknowledge and agree that ads may be shown to you and your event guests. Upgrading to a paid tier removes all advertisements.

7. Storage and Data Retention

  • Each tier includes specific storage limits and active window durations.
  • After the active upload window expires, guest uploads are disabled.
  • After the gallery viewing window expires, the event enters cold storage.
  • After the cold storage period, event data and media are permanently deleted.
  • You can download your media during the active and gallery windows.

8. AI Features and Biometric Data

The Service offers AI-powered features including photo generation and face recognition. AI-generated content is created using third-party AI models. By using these features, you acknowledge that:

  • AI-generated images may not be perfect and are provided "as is."
  • AI features consume credits that are included with your tier or purchasable as add-ons.
  • Your uploaded photos are not used to train AI models.

8.1 Face Recognition and Biometric Data

When you enable face grouping for an event, the Service processes uploaded photos to detect and group faces. This involves generating mathematical representations ("face embeddings") from facial features in your photos. These embeddings may constitute biometric data under certain state laws (e.g., Illinois BIPA, Texas CUBI, Washington).

  • Purpose: Face embeddings are used solely to group photos by person within your event gallery.
  • Storage: Face embeddings are stored only for the duration of your event's retention period.
  • Deletion: When your event is deleted or expires, all face embeddings are permanently deleted along with the event data.
  • No sharing: Face data is never sold, shared with third parties, or used for surveillance or identification purposes.
  • Opt-in only: Face grouping is only activated when the event host explicitly enables it.

By enabling face grouping, you consent to the collection and processing of biometric data as described above. You may disable face grouping at any time from your event dashboard, which will remove all face embeddings for that event.

9. Prohibited Uses

You agree not to:

  • Use the Service for any illegal purpose.
  • Attempt to gain unauthorized access to the Service or its systems.
  • Interfere with or disrupt the Service's infrastructure.
  • Scrape, crawl, or harvest data from the Service without permission.
  • Use the Service to distribute spam, malware, or unsolicited communications.
  • Resell or redistribute the Service without authorization.

10. Copyright and DMCA

We respect the intellectual property rights of others. If you believe that content on the Service infringes your copyright, you may submit a takedown notice to our designated agent with the following information:

  • A description of the copyrighted work you claim has been infringed.
  • The URL or location of the infringing content on our Service.
  • Your contact information (name, email, phone number).
  • A statement that you have a good faith belief that the use is not authorized by the copyright owner.
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.
  • Your physical or electronic signature.

We will respond to valid notices promptly and may remove or disable access to the allegedly infringing content. Repeat infringers may have their accounts terminated.

11. Intellectual Property

The Yealo name, logo, design, and all related trademarks are our property. The Service's code, design, and functionality are protected by copyright and intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

11. Limitation of Liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Yealo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, media, profits, or goodwill, arising from your use of the Service.

Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Termination

We may suspend or terminate your account at any time for violation of these terms. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately, and your data will be deleted according to our retention policies.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated terms on this page. Your continued use of the Service after changes constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of the applicable jurisdiction.
